Please read these Terms of Use ("Terms") carefully before downloading or using the Calorie Counter & AI Tracker mobile application ("App") or website at calorie-counter.site ("Website").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and the Calorie Counter & AI Tracker application provider ("we," "us," or "our"). Your use of the App constitutes your acceptance of these Terms and our Privacy Policy, which is incorporated herein by reference.
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you must have permission from a parent or legal guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple iOS device that you own or control, solely for your personal, non-commercial purposes, subject to these Terms and Apple's App Store Terms of Service.

The calorie counts, nutritional information, and AI-generated food estimates provided by the App are approximations and may not be fully accurate. Always consult with a qualified healthcare professional before making significant changes to your diet or exercise routine, especially if you have any medical conditions, allergies, or dietary restrictions. Never disregard professional medical advice or delay seeking it because of information provided in the App.
The App offers optional paid subscription plans with the following pricing:
All purchases are processed through Apple's App Store. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple ID Account Settings. No refunds are provided for the current subscription period upon cancellation.
Free trials, if offered, will automatically convert to paid subscriptions unless cancelled before the trial period ends.
You retain ownership of any content you submit or upload to the App ("User Content"), including meal photos and food logs. By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, process, and store your User Content solely for the purpose of providing and improving the App's services.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it. You agree not to submit any content that is unlawful, harmful, offensive, or violates any third-party rights.
Your use of the App is also governed by our Privacy Policy, available at calorie-counter.site/privacy/. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.
The App and all of its content, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software) are owned by us or our licensors and are protected by intellectual property laws. You may not use our trademarks, logos, or other proprietary information without our prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INCLUDING NUTRITIONAL INFORMATION AND AI-GENERATED FOOD ESTIMATES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
If you download the App from Apple's App Store, the following terms apply:
We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on this page with a revised "Last updated" date. Your continued use of the App after the effective date of any changes constitutes your acceptance of the new Terms.
These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in courts of competent jurisdiction.
